1. Acceptance of Terms
These Terms of Use ("Terms") constitute a legally binding agreement between you ("User", "you") and Render AI ("Render", "we", "us", "our"). By creating an account, accessing, or using our AI image and video generation service (the "Service"), you agree to comply with and be bound by these Terms.
We reserve the right to update these Terms at any time. Continued use of the Service after changes are posted constitutes acceptance of the updated Terms. We will provide reasonable notice of material changes via in-app notification or email.
2. Eligibility & Age Requirements
2.1 Minimum Age
The Service is intended for users who are at least 13 years of age. In jurisdictions where the minimum age for data processing consent is higher (such as 16 in certain EU member states), the higher age limit applies.
By using the Service, you represent and warrant that you meet the applicable minimum age requirement.
2.2 Use by Minors (13–17)
Users between the ages of 13 and 17 may only use the Service with the verifiable consent and supervision of a parent or legal guardian. The parent or guardian accepts responsibility for ensuring the minor's compliance with these Terms.
2.3 Children Under 13
We do not knowingly allow children under 13 to create accounts or use the Service. If we discover that a user under 13 has created an account, we will immediately terminate the account and delete all associated data. Parents who believe their child under 13 has registered must contact us at [email protected] for immediate removal.
3. Account Registration
To access the Service, you must create an account. You agree to:
- Provide accurate, current, and complete registration information
- Maintain the security and confidentiality of your account credentials
- Notify us immediately of any unauthorized use of your account
- Accept responsibility for all activities that occur under your account
You may not create accounts for others without their authorization, impersonate any person, or use false information during registration.
4. License to Use the Service
Subject to these Terms, Render grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial purposes.
You may not:
- Reverse-engineer, decompile, or disassemble any part of the Service
- Use the Service to build a competing product or service
- Scrape, crawl, or systematically extract data from the Service
- Circumvent any access controls or security features
- Use automated means to access the Service without our prior written consent
5. Content Policy
5.1 Prohibited Content
You agree not to use the Service to generate, submit, or distribute content that:
- Depicts, exploits, or sexualizes minors in any way (strictly prohibited and will be reported to authorities)
- Is defamatory, obscene, threatening, or harassing
- Violates any applicable laws or regulations
- Infringes third-party intellectual property rights
- Promotes violence, terrorism, or self-harm
- Contains malware, viruses, or harmful code
5.2 Ownership of Generated Content
You retain ownership of the content you generate through the Service, subject to these Terms and applicable law. By generating content, you grant Render a limited license to store and process that content for the purpose of delivering the Service.
6. Privacy & Data
Your use of the Service is subject to our Privacy Policy, which is incorporated into these Terms by reference.
As explicitly stated in our Privacy Policy: we do not transmit your personal information or content to any third-party APIs or external services. All processing occurs within our secure internal infrastructure.
7. Account Deletion & Termination
7.1 Deletion by You
You may delete your account at any time through one of the following methods:
- In-App: Navigate to Settings → Account → Delete Account and follow the confirmation prompts.
- By Request: Email [email protected] from your registered email address with subject line "Account Deletion Request".
Upon confirmed deletion, all personal data associated with your account will be permanently removed within 30 days in accordance with our Privacy Policy.
7.2 What is Removed
Account deletion results in the permanent removal of:
- Profile information (name, email, avatar)
- All generated images and videos
- Prompt history and saved creations
- Subscription and payment records (subject to legal retention requirements)
- App preferences and settings
7.3 Termination by Render
We reserve the right to suspend or terminate your account at our discretion if you violate these Terms, engage in fraudulent activity, or pose a risk to other users or the integrity of the Service. Where feasible, we will provide notice prior to termination.
8. Subscriptions & Payments
Certain features of the Service may require a paid subscription. Subscription fees are billed in advance on a recurring basis. By subscribing, you authorize us to charge your payment method for the applicable fees.
Refunds are handled in accordance with our refund policy and the policies of the applicable app store (Apple App Store or Google Play). Account deletion does not automatically entitle you to a refund for unused subscription time.
9. Disclaimer of Warranties
The Service is provided "as is" and "as available" without warranties of any kind, express or implied. We do not warrant that the Service will be uninterrupted, error-free, or that AI-generated content will meet your specific requirements or expectations.
10. Limitation of Liability
To the maximum extent permitted by applicable law, Render and its affiliates, directors, employees, and licensors shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of the Service, even if advised of the possibility of such damages.
11. Governing Law
These Terms shall be governed by and construed in accordance with applicable laws. Any disputes arising under these Terms will be resolved through good-faith negotiation, and if unresolved, through binding arbitration or courts of competent jurisdiction.
